Old Lyme Board of Selectmen
Regular Meeting Monday, June 20, 2005 APPROVED

The Board of Selectmen held a regular meeting at 7:30 P.M. on Monday, June 20, 2005 at Memorial Town Hall Auditorium.  First Selectman Timothy Griswold, Selectman Skip
Sibley and Selectwoman Bonnie Reemsnyder were present.

Approval of Minutes:  June 6, 2005
The minutes of June 6, 2005 and June 20, 2005 will be approved at the next Board of Selectmen’s meeting in July.

Communications:
Andrew Powaleny – Town of Old Lyme Scholarship Award
Each year the Town of Old Lyme awards a scholarship to a graduating senior who is interested in governmental work.   The recipient this year is Andrew Powaleny whose political background ranges from helping with State and local elections to serving as the Town of Old Lyme congressional campaign coordinator for Congressman Simmons.  The Board congratulates Andrew.

b.  Rogers Lake Authority Meeting – June 25 Noon – Rogers Lake Com Center
The Rogers Lake Authority will meet on Saturday, June 25th at noon at the Rogers Lake Community Center to further discuss the issue of weed control in Rogers Lake.  There will be no activity this year, but there will be discussion on hydroraking by private parties as well public comments on a weed program for the lake.

Appointments:
Adelphia Cable Advisory Council – John Alexander (R) – 2 Yr Term to June 07
John Alexander was previously nominated to complete the term, which ended June 2005.
Selectwoman Reemsnyder made a motion to appoint John Alexander (R  to the two-year term to June 2007.  Selectman Sibley seconded the motion.  SO VOTED

Old Business:
Church Corner – Possible State/Federal Funding.
The Regional Planning Agency has reported there is Federal money for road projects such as the Church Corner on Lyme Street.  In fiscal year 2005, there is $525,000 available to the nine-town area of the Connecticut River and in fiscal year 2006, there may be $450,000-$500,000 available. The Federal fiscal year ends September 30.  Old Lyme’s planning agency falls under the New Haven area for this kind of funding, so it will be necessary to communicate with New Haven as well as State of Connecticut.  Projects are not given a green light until the lengthy DOT design and review process is completed.  The course of action will be to move forward by putting the drawings together and getting them to the DEP with the anticipation that the money will follow. There are three projects being considered in the nine-town area to be helped with the 2005 – 2006 funds.  One project is Church Corner on Lyme Street. Another project is Main Street to the railroad station in Old Saybrook.  A third project is a safety issue study of Route 154 in the Essex area to Old Saybrook.  The three projects could be funded with

the available money if we receive approval to roll it over.  Tony Hendriks will get a cost estimate for the engineering.

ARIA, LLC – Open Space Proposal – Disapproval by Planning
The Planning Commission officially disapproved the purchase of the ARIA, LLC property off the Boston Post Road.  The Open Space Committee also voted to disapprove the purchase.   

Abandonment of a Portion of Ben Franklin Road – Status
It was agreed by local owner David Dangramond, Town Historian Ned Pfeiffer, Town Atty. Marylin Clarke and First Selectman Griswold to work on an agreement that will provide future limited and controlled access to the right-of-way area for historical research.  Insurance to indemnify the owners will be necessary.

Lyme Street Reconstruction Project – Update
The Lyme Street reconstruction project is nearly completed except for some curbing and drainage issues as well as sidewalk work. The crosswalk will be reinstalled on the south side of Library Lane to the ice cream shop. The granite curbing in this area is not yet handicap accessible.  Yellow paint will identify no parking areas at the intersection.

Town Woods Field House – Ribbon Cutting
Sen. Stillman and Rep. Giuliano attended the ribbon cutting ceremony at the Town Woods field house on Saturday, June 18th.  Anthony Basilio from Illiano’s opened his concession stand at the site.  The VFW dedicated a flagpole complete with a light.  The Playground Committee is busy with fundraising.  

Sound View Village District – Public Hearing – June 27, 7:30 P.M. Middle School
A public hearing on the Sound View Village District will take place on Monday, June 27, 2005 at 7:30 P.M. in the Middle School.  

Wood Crest Estates Subdivision – Road Restoration & Sedimentation Fees
At the last Board of Selectmen’s meeting, there was a discussion on bond requirements for Wood Crest Estates, also known as Miano property, located north of Point O’Woods.  In the regulations, Kevin Kenny of Kenwood LLC has an to either put up a bond in the anticipation of selling lots or put up a restoration bond without the ability to sell lots.  Once the lots start selling, the rest of the bond must be put up.  Mr. Kenny has opted for the restoration bond and sedimentation control.  Thomas Metcalf, the engineer, has calculated the value of the restoration bond at $167,000 and the sedimentation control bond at $15,200. Those amounts are to be handled by Land Use Dept.  With respect to the Board of Selectmen, 2-½% of the amounts or  $4,556 will be placed in an account for
future expenses.  Selectwoman Reemsnyder made a motion to have 2 ½% of the restoration bond and the sedimentation control bond totaling  $4,556 posted in a separate account.  Selectman Sibley seconded the motion.  SO VOTED.

Town Forum – Reschedule from June 29, 2005 to July 20, 2005
The Town Forum has been rescheduled from June 29, 2005 to July 20, 2005 at the Middle School Auditorium at 7:30 P.M.

5.  New Business:
Rep. Giuliano – Motorboat Noise Legislation
The General Assembly has approved legislation designed to curb excessive noise of motorboats. The proposed bill now awaits the signature of Gov. M. Jodi Rell.  This bill would increase the fine for people who’s motorboats exceed the designated noise levels as well as people who refuse the submit to motorboat noise tests.

Inland/Wetlands Citations & Fines Ordinance – Recommend Approval  
Inland/Wetlands seeks to have an ordinance that would provide the ability to use penalties and remedies for violations of the Old Lyme Inland/Wetlands and Watercourses regulations.  It would establish citations and fines for violations, as authorized by the State of Connecticut General Statutes.  The fine for each citation shall be not less than $250 and not more than $1,000, based on the severity of the environmental impact.  The First Selectman shall appoint one or more hearing officers to conduct hearings necessary to effect this ordinance.  Selectman Sibley made a motion that the Board of Selectmen recommends approval of the above-explained ordinance at a town meeting.  Selectwoman Reemsnyder seconded the motion.  SO VOTED.  

c.  Florence Griswold Museum – Neighborhood Assistance Act – Public Hearing June 28, 2005 11 A.M. Town Hall
The Florence Griswold Museum, in conjunction with the State of Connecticut Neighborhood Assistance Act, is able to do educational work within town and provide tax credits for the supporters of the museum. The State of Connecticut requires the sponsoring town to have a public hearing for discussion. The Board of Selectmen will hold the hearing on Tuesday, June 28, 2005 at 11:00 A.M. in the Conference Room in the Old Lyme Town Hall to request $75,000 for educational programs at the museum.  Comments may be heard and written communications received.  Copies of the proposal are available in the Selectmen’s office.

Darian Sheffield – Purchase of 153 SF of Town Land on 4 Mile River Road
Darian Sheffield owns property off Four Mile River Road and has recently acquired a lot in front of his property.  In order for the lot to be conforming to Zoning regulations, he needs a small amount of land.  There is available adjacent town-owned land to make an adjustment in the line to provide the appropriate area for the lot.   He will do a lot line
modification between his property and the new property.  The town needs to arrive at a price for the 153-sq. ft. parcel.  More information will be available at the next Selectmen’s meeting.

e. OLFD – Recommend FY 05 Financial Security Plan Contribution Amount
The Board of Finance will consider the 2005 fiscal year Financial Security Plan contribution.  The budget of $35,000 for last year was divided by 58 active fire and ambulance volunteers and each member received $603.  This year the budget is the same but there is one more volunteer which would reduce the amount to $593 for each member.  Selectman Sibley would like to see an added 3% cost of living allowance mechanism as well.  Selectwoman Reemsnyder suggested that the Board of Finance at least consider the added amount for cost of living allowance.  Selectman Sibley made a motion that the Board of Selectmen recommend to the Board of Finance that the funding stay at least at the present level for this year and strongly consider adding monies to accommodate the additional personnel and incorporate a 3% cost of living adjustment.  Selectwoman Reemsnyder seconded the motion. SO VOTED. First Selectman Sibley amended his motion to recommend to the Board of Finance that the funding stay at least at the present level for this year and strongly consider adding monies to accommodate an additional person and incorporate an additional 3% increase, deleting the cost of living language.  Selectwoman Reemsnyder seconded the amended motion.  SO VOTED.

OLFD – Recommend 10% Federal Match Amount
The Old Lyme Fire Department has been approved for $115,000 grant for radio equipment, 90% of which would be paid through the Federal Government and 10% is the town’s share ($11,500). The Board of Finance was at the end of the budget and so did not vote on this.  Selectman Sibley made a motion to recommend that the Board of Finance appropriate $11,500 for the 10% of the Federal grant through FEMA.  Selectwoman Reemsnyder seconded the motion.  SO VOTED.

Adam Burrows Retirement
The retirement party for retiring Center School Principal Adam Burrows was well attended. The Board of Selectmen wishes him well.

i.  Harbor Mgt. Commission – Recognition of Past Chairs
The Harbor Management Commission had a ceremony recognizing four past chairmen,
Ron Wojcik, Rod White, Bob Getman and John J. Speirs.
